I posted last week explaining a little of my 17 year old ky. wc case.Since,the ic has been calling saying they are making a settlement offer which should cover my medical cost from here no out.I do not have an att. yet so I called a specialist with wc board and she informed me that since I have medicare/medicade with my 100% bisability I can loose my benefits because of settlement.I have never been given any checks from ic.I was also not aware of reimbursment for milage until a week ago.I am still facing alot of medical costs.Can anyone tell what else i am entitled to and what rules apply to someone who has disability?

call medicaid and ask for help now

I would call your adjuster and see why you were not paid for your mileage to your doctors appts. and if there is any way to be reimbursed. If you went every month to the same doctor and it is documented it should be easy to figure out how much they owe you.

it depends on whether your disability is temporary or permanent.
the rules on workers comp under Kentucky law are on their website

1171,I have permanent total disability.I have reviewed the guidebook from page 21 on.I am still not sure where I would fall in this since my injury was in 1991 and I went to court in 1994.Maybe I am missing something.I received ptd last year but they backed up a couple of years.I continued to work ror 6 years after I got my lifetime med. in 1994.It finally got to the point that I could not stand the pain any longer.I had my 1 surgery in 2002 and my 2 in April this year.I have never asked for anything but med bills paid and now they are disputing them.What is your opion.You seem to really know your stuff and i would greatly appreciate your opion and any info on this matter

you are entitled to disability payments from the carrier.
it's unusual to be permanently totally disabled and to continue to work.
if you settle with a have medicare setaside trust you can have all your medical bills paid from the trust acct without the hassels of a carrier denial.

I continued to work until 2001.My ptd dated back to 2002.I am not able to work now.Would I continoe to draw ssd with the carrier disability payments or I would I choose which would be greater?Also, do you believe that the setaside would cover me for alot of years?I have been trying to contact ss for 2 days but the line is always busy.Again,thank you for your time.[/align]

once the set aside trust money runs out your medical will be paid directly from your medicare benefits.
