I have been injured (100 percent disabled) coming up on 18 years. When I was injured the insurance company made a lifecare plan to take care of me for the rest of my life. In the lifecare plan I am to receive a new vehicle every 4 to 5 years. Last November was 5 years. I have approached worker's comp and they say all because the lifecare plan says that it doesn't mean I will get a vehicle every 4 to 5 years. My question is if the insurance company put away X amount of dollars to take care of me shouldn't I be entitled to a new vehicle. The money was put away to take care of me which includes a new vehicle. Any information is appreciated. Thank you, HACKNSACK44

A lifecare plan is not a contract or a medical savings acct.
What happens if things change or they run out of the money they put aside or they end up with "extra"?
Who pays for vehicle maintenance and repair?
Disputes can be brought back to the comp court. If you had representation at the time of the comp award you may wish to get their opinion.

In a lifecare plan, things are put in as a way of getting an idea of how much the insurance company "might" have to pay in the future. It does not mean you get a car every 4-5 years. If your car is still running they would most likely not replace it. As 1171 said, it is not a contract. It is an estimate of what they could possibly be responsible for.

I never heard of someone getting a car for WC. Are you a handicap person that has a special van? I am just curious , cause like i said, i have NEVER heard of anything like this. Why do they give a car?

Thank you for the info. I know alot (millions) was put in an annuity to take care of me and not much gets used yearly. I pay for all maintenance and repair for 5 years. It is court ordered that way. I was paralized on the job so I need a hanicap vehicle. I am not like a AB person if van breaks down I can't jump into a regular vehicle. Thanks again

Sorry to hear that. I really never knew that they pay for a handicap vehicle. I was always curious how that worked out. I had a very good friend I knew when I worked at the hospital that was handicapped, and I know he had a van, but never even thought about how he got it and who paid for all the functions that it did on it for his wheelchair.
