ok new info - holla85 - 01-25-2012 11:34 PM ok so i found out new info about my case and need a little help... i called ny state workers comp board. i asked them for a status for my cases. i have two. one was my rt shoulder, where i saw my dr and the ime for schedule use of loss. both agreed with the percentage of 20 % loss of use, which happen in 9/2010 . the next case happen in 5/2009 which was my rt elbow that also saw both dr. and ime for a agreed loss of use of 15%.. so my legal advisor told me, he sent a email to the city attorney to discuss the case. after a couple of weeks he got no response. so he filed a request for a decison with the workers comp board. So i decided to call the board to find out my status on both cases.. the lady was helpful and told me that my rt shoulder case, the insurance company filed for a hearing and with my rt elbow, my legal advisor filed for a hearing. huh??? so my questions are a why wouldnt they (city attorney)settle with my cases right away being they are clear cut? and two should i expect anything anything unnormal than the fact that my award should be the amount that is stated by nys worker comp chart. should I be worried about anything unexpected. or is this a ploy to stall on paying out. Im a law enforcement officer and ive been doing my research on workers comp the hearing will not be for another two months she stated if that getting very impatient can anyone help with this and give me a idea whats going on RE: ok new info - jayne - 01-26-2012 12:10 AM people get impatient with speed laws and speed you give em a speeding ticket...you get impatient in WC court and it can cost you money.Most settlement are not cut and dried there is a bit of give and take..and sometimes a lot of stalling just for fun...sit back and be patient.hard to do isnt it? Thanks Jayne. But should I worry about. How there going about this. Is there reasons behind there method. I quite didn't understand the speed thing but ok. I'm more concern about clear cut injuries that are now going to hearings. For what??? Is there something I need to worry about or another tactical ploy by the other attorney. I worked for the government, not law enforcement, but the city, the city I live in. Even though your ratings are "cut and dry" as you say, it is still not that easy. WC insurance companies will still try to find a way to stall or undercut the $$$'s owed you. My attorney has been sending my city's WC insurance Co. letter's for settlement for a while and have gotten no response. Being that my city is selfinsured, it may not be in their "fiscal budget" to settle all at once. Even though it will cost them 3 1/2 times the amount to pay me over my lifetime at my biweekly payment amount. I am 75% perm. partial disabled. Not sure if where you are is selfinsured being a law enforcement agency, even though it is still part of government. NYS is rediculous, so be patient, my case is has just entered it's 6th year, however I had a 3 year span of surgeries which ended in 2010. Good luck!
