settlement offer - scotkr2 - 12-09-2011 12:01 AM
my husband has had 2 back surgerys and has 2 herniated discs. his attrny states they say he is 25% disabled and they offered him 17000.00 the first offer and now they offered him 29000.00 is this a good amount?? the atrny says the most he will probable get is 2000 more..... my husband made minimum wage he was 24 when her hurt his back at target what do u all think??? he had 2 herniated disc which took 2 surgeries to repair. but once he was hurt they took away 0.50 per hour because he could not perform his job and since he has been realeased with no restrictions he ask for more hours and his HR lady said and im quoting "We can not give you any more hours because your a liabillity since u have been hurt we dont want you to hurt yourself again" do we have a case based on this quote to sue target!!! he has only gotten 20 hr since being hurt max

i think it depends on what state; each has different rates.

your husband will hurt all his life.but the rules were made to cover the employer.If this is with open medical it is about all you are going to get.I would do my best to keep medical open.good luck

25% rating is just one measure; all factors that may affect your husbands future earning capacity should be used to determine settlement value.

I had the same injury no surgeries except my left shoulder,mr dr wanted a lot of medical treatment ,but their dr rated me at 30% .at settlement time I settled for 40,000.Not sure how much comes my way yet but open medical wouldn't have helped me since now i live in another state and Drs.take California comp and had to pay cash to get one to see me.so i comp&released.At this point just glad its over.
Also i knew i i wouldnt get rich so i feel lucky i got to name my number.Agood deal is when nobody feels happy.
