Can I go back on??? - robyn552 - 06-21-2011 03:57 PM
Is it possible to get back on workers comp after being released? I have not been on workers comp in three years and now I am having problems that are directly related to my injury. I dont want money I want the medical treatment so I can feel better. I can't work, I can barely put my clothes on in the mornings. I just need to know what my options are.

depends on your state.
most have time limits and different types of closures.
in any event you'll need a medical opinion that your current problems are caused by what happened at work 3 years ago and not anything since then.

the case was "closed", but I never signed off on it. I called the state workers comp place today and I called the carrier that dealt with my claim to see what could be done. The doctor wants to do an MRI to make sure if it is related to my injury or a pre existing condition. I am in Texas and I don't know anything about worker comp. Come to find out when I was going through it before I got jacked out of a lot of benefits.

hopefully you filled a DWC-41 with the DWC when you were first injured.
you will not be entitled to benefits without supporting medical opinion.
your health insurance should be willing to authorize the MRI and doctor's visit to determine if it is related to your prior injury.
if it is then they will file a lien against your claim.
