Im a housekeeper in Oregon. Due to defective equipment I sustained on job injury right shoulder rotator cuff. Worker comp accepts. Light duty . Surgery. Back to light duty 27 days later. Light duty for 4 months. Job terminates me due to unable to accomidate modified duty. Final check.Unemployment investigates states - discharged.Boss says no, not terminated just pending. Dr. has no more treatment. Requests voc training. Now getting time loss$. Assessed for voc training. IME appointment. WC claims he states I can go back to old job full duty. I have ongoing issues with shoulder, afraid of retaliation from staff (loss of safety bonuses) not to mention someone else has been doing my job since March. If Iam being released to full duty, whats to stop them from getting me to quit. Quit-no unemloyment, no voc training no settlement? Just hired lawyer 2 days ago. Also WC had set up another IME appt. Sorry so long of message but I cant condense this any shorter. Thanx

be ready to get screwed over by the IME appt...bet you they fine nothing wrong with you. just never give up if your hurt your hurt just need to make sure your doctor is good...

Remember the IME was set up by your employer and they are paying for the visit. Some IME's are just a doctor looking at you and letting them know what he thinks is wrong. But then some are a doctor seeing you walk in the door and tell them what they want to hear and how you are just fine and should never have been off work in the first place. If you are hurt the real doctors can tell the difference and their reports will tell the truth. Good luck

Thanks, they said Im great! no problem. Didnt do any physical testing. Thanks for your input

For mine my lawyer told me to call him on the way home and tell him how it went. It was a 3 hour ride so plenty of time. Told him a few of the places the doctor tried to mess me up and he would lie about so that part was kind of funny. Had to take all my records with me which he refused to take saying he had them all. He had a folder that was 10 times bigger then my records and my wifes combined. He should have used them because in his report and then in the depo he messed up big time saying they had done things to me the were not right but those things never happened and were not in the records. I think he does so many IME reports he must have had several different files together when he did the report. You would think he is smart enough to know they get a copy of all my records and can check what he is saying. I think this guy was thinking he was God and everything he wrote wass the truth. He made himself look like a complete fool in the eyes of the hearing officers with all the things that were wrong. I think his report, while paid for by my employer and meant to stop me from getting any further treatment, really helped me. This is one doctor that they should pull his practice

I;m still trying to keep the faith that good will overcome evil.

If I had not hired a lawyer I would have been out on my butt years ago. Now yes my lawyer has made some money off the delays but he is also looking into getting this problem cover for life. This is why we hire them, because if we don't the would never take care of those that need expensive medical care. It is a game and your lawyer helps make them play as near the rules as he can.
