I'm been waiting to get worker comp for almost 2 years and I fould out I have nerve damage in my knee called RSDS and I'll need meds and to see doctor every 2 weeks for the rest of my life. My lawyer want me to settle for around 150k that will non-include my medical cost for the rest of my life. I wanted to know what you think I should do.

first and formost is your medical....the pros will be on in a bit.... its slow on the weekends.... they will need your state.... your date of injury ...and all the info you can give them them to help you

Type of injury, what was done for it?

Has RSD been confirmed and in medical reports?

Can you walk, can you work, have you been released to work?

What type medical treatment are you getting.

You do know in some cases, RSD can go away?

I got injuried on 12/26/2008 and I live in the state of Michigan.
How will I get treatment is I would have to pay for it for myself. and seeing a pain doctor would cost $1000 a visit

And just how much money you think in real life your going to have after paying attorney fee's and those $1,000.00 medical visit bills?

check out your life expectancy

and estimate your yearly medical costs.
use a Present Value calculator to get an idea as to the current value of the settlement.

the present value (@4%) of $3000/mth medical for 40 yrs= $725,200

I will have to pay the attorney $14,000 in fee's I also have to payback BCBS; Caremark; and food stamps. I will get back around $40,000 after paying everyone back. I also do not have medicare aside. I'll maybe get medicaid and that will pay for almost nothing. The otherside think I'll be okay in few years because I'm only 28 year old but my doctor tell me I'll probably have to have treatment for the rest of my life

$40,000.00 and you go to visits at $1,000.00 each ='s 40 medical visits and your broke. Hello, hardly even enough to pay for several years of medical visits. Plus, you stated attorney's fees based on total amount, you didn't mention any of the attorney add on fee's that are also applied to the Percentage they take. That $14,000.00 can turn into $25,000.00 real fast.

From what your saying here, why your paying BCBS and not the work comp IC, as BCBS has a Lien placed on your settlement, your attorney isn't doing much to help you, other then making sure there is some money for you (not the IC) to pay all that money back. Sounds like your getting the shaft.
