I was injured at work on April 2010 and I have been home on workers comp since then. Lately I have been receiving calls from workers comp reps and nurse case managers that I didn't receive earlier during my injury. I had to have surgery on my eye in May after being kicked and I haven't been released from the doctor's care yet. Is workers comp trying to get me to return to work before my release date and can they do that? I really fear getting hurt again before I've fully recovered. What should I do at this point?

It is hard to say. Why did the NCM call you???? Some NCM's are good and others are not.

yes, but any return to work has to be medically approved.
most work comp programs encourage early return to work and have extensive light work/modified work programs.
the negative effects of a work injury are increased the longer one is out of work.
discuss your situation with you doctor and employer.

The NCM stated that she just wanted to make sure I got all the services I needed, but where was she when I really needed help? Now that I'm going through the healing process she shows up. I don't need her for anything. The biggest hurdle is over. Where was she when I needed to find a good doctor and a good surgeon? Why come around now?

The NCM works for the IC. It appears that the IC saw no need for the expense until now. Most WC claims are simple and short. There for there is no need for a NCM. I know that my NCM only shows up every other year. Just to confirm my present condition.

No they don't know how I feel and I'm sure they are not concerned. I'm still having serious problems with my eye and they care less and this whole process is becoming very stressful and depressing.

why is it stressful? are you being taken care of as far as medically? are you getting your TTD checks?what was you kicked by? if you went back to work lite duty what would you be doing? do you know? Light duty is full pay so that is a plus.....so think about it....if you feel you are being railroaded it may be time to talk to a lawyer...but that is your call....

you might consider getting an atty or representative so you don't have to deal directly with the issues.

It's stressful because it seems like everyday now there's a different problem and they are asking for paper work and forms they have never asked for and I've been on workers comp since April. I was kicked by a teenager at a youth facility and I had to have surgery on my eye to have it reset because it was falling back so I had to have a plate and screws placed in my eye and my eye had to be pulled forward. The recovery has been hell so the last thing I need is workers comp coming up with something new everyday. Maybe if they took a look at my still swollen, black eye, after four months still, they will leave me alone and let me heal.
