I can't seem to stop worrying about my case. I wrote about it in a previous post ( do I have a case? ) Why is nobody from the WC telling me what is going on? Why did they hire a PI? I told the truth, I was a good honest employee. Has anybody ever experienced this? I'm just thinking about this all the time? Is there anybody I can call about my case ( besides my case manager ) ? She never returns my calls? I just want all this to be over! Would welcome some advise please.

It's a litigious system that has very little do do with typical medical care. You did your part and now the other side gets to do theirs. The outcome is unpredictable regardless of your honesty but you should be ok in the long run and at times a work comp case is never truly over. Worrying is part of the experience.

Thanks so much for your reply! I really appreciate your concern. I just don't want to be made out to be a bad person in all this. Trying to go through this with not knowing anything about W/C is really frustrating. I'm so glad I found this site! Any more I should know about a new claim under investigation? Any replies or advice would be welcome!

A PI is also a fact checker and data gatherer.
it doesn't mean you're a fraud or anyone is.
there are many players in the comp system from doctors to confused employers.
where $$ are involved it's not unusual to verify first especially when you have to separate the work condition from the non-work.

P.S. if you are going to post you should put your state in your profile as each state has separate comp laws and it will help those who want to respond.

it sounds like your claim is in delay and not formally denied?
what the status?

P.S.S. if it has not been denied you still have $10,000 of medical care that will be covered.

Thanks for your reply! I'm from California. They have not told me if the case is denied yet, so i think it must be delayed. Nobody really has told me. So I won't have to pay for my last three Dr. appts.? And I have a Ortho.appt. coming up. I've been so worried, thanks! I just wish my WC adjuster will let me know what is going on. Are they suppose to communicate with me?

Do you have an attorney involved, if you do they will communicate directly with the attorney not with you. if no attorney is involved then they should communicate directly with you. Hope this helps you with communication.

they should have sent you a notice that it was delayed.
they have 90 days to gather information and investigate.
use the links I provided in your previous post.
you will have to continue to take the initiative to become informed-adjusters, attys, doctors, are not work comp trainers, teachers, or help desks.
if you are going to loose sleep, it should be from reading about work comp rules and how it can affect you.....

Thanks for your reply! No I don't have an Attorney. My pay was only $10 an hour or so. ( it varied from job to job ) I don't think it would be worth it to them, Im not sure. Nobody is calling me. Is it ok to keep calling my Claims Adjuster? She's always out of her office and only has called me once since this all started on March 19.

Do I have a case?

On 3/19/2010 while working as a caregiver in Ca. I attempted to lift a pt. I immediately felt a sharp pain and burning in my back. I called my employer immediatley to report the incident. I had been to the Workers Comp. Dr. twice before in the past year, once for a fall, and once for an assault by a mentally unstable client who had brandished a knife. During the course of those visits I had mentioned my prexisting back condition ( disk protrusions L3, L4, L5- S1 which are at their maximum on the left side measures about 3mm and indents the S1 nerve root). the Dr. told me that my primary Dr. would have to address those issues. When I reported the incident I told them I was sick and hurt my back. My company is now saying I reported being sick but no mention of my back. They are now fighting the claim and have hired a P.I. I'm so confused as to what to do. Should I hire an Attorney? Should I even fight this? Oh by the way I'm new to this site and really can relate to a lot of the pain and frustration that people are feeling. I would love some advise.

How do you know a P.I. was hired? For if you know this, your in comuniacation with someone, and getting information you need.

Next, your wondering if your going to have any problems? it is possible as you stated, you have been informing WC doctor's that you do have ON-Going Pre- Exsiting medical condtions of the Spinal vertebre's and Disc. The P.I. will also be doing medical report findings. This is something normal a P.I. is getting paid to do. Next, the P.I. just may follow you, to see if your staying within the medical Restrictions the doctor or surgeon have you on. P.I.'s are also known to make visits with your neighbors and co-workers. Getting statements to the facts your truly showing an injury to being at work.

Next, in this Thread you stated no one answered you in your other Thread, ( do I have a case? ) yet there were 2 pages of replies on that Thread. I can see you must be Nervous about this. yet, there is little you can do till the Investagation is over. Since there is nothing you can do, I would suggest you keep you mind on healing, and trying to get better no matter what. As that is the most important thing for you. Your Work Comp Case is only going to go 1 or 2 ways. It will be excepted, or it will be denied. And that is that. Then if denied, you have a choice of what you wish to do from there, such as Appeal the Denial. That is all you can do at this point and time. So, relax and heal.

The only letter that was sent was asking for my previous Drs. of the last 10 years and a mileage form. Oh I went to that link and loved it! Thank you!
