I am very new to this and need info on what to expect. I was injured at work in Aug. 09 and have been receiving weekly money from IC but they ignore medical bills even though I have sent them copies. They have never required me to see a doctor of their choice but I did offer. I have been under a doctors care for the injury paying for it myself. Now I need serious surgery and they are requiring a blanket medical release form signed to determine if my case is workmans comp. I feel IC should done this 7 months ago and why now? Why should I share with them my medical information when I have been paying for it. I think I need a lawyer. Any advice? [/font][/size]Thank you for any information or advice. bd

Attorney or no Attorney you will give them access to the medical information or you will suffer more waiting time then you ever wish to see. Do you need an attorney, maybe so. Might help with the medical bills later. But, if the IC agrees to payment, their still allowed your medical records.

strange that they would pay the disability but not the medical.
are you sure you're getting Temporary disability from workers comp and not short term disability for a non-industrial condition?
you can ignore the request, pay the surgery yourself and see if they continue disability payments.
if they stop the payments and you want them restarted you'll probably have to take the issue to the comp court.

The weekly checks say temporary total. Whatever that means. This is a complex situation. It is non-industrial. I am an RN and was hurt by a patient when he was waking up from surgery and became aggressive. Slugged me in the chest and broke my pacemaker wire. Messy situation. Big expense to IC so I think they are dragging their feet on purpose. Now facing chest surgery. What should I expect the IC to do next? Lawyer?

like I said: see if they stop the disability if you don't comply with the medical release.
I don't know what the issues are with paying your medical.
you can litigate any time; it's likely that everything will go into slow motion when you do.

I Read Your Thread and May have Missed the State You are in, but if You are Receiving Total Temporary Disability Payments: (TTD), they have Accepted Your Claim as a Workplace Injury, and You should be Receiving Medical Care also! My Suggestion would be a Good w/c Attorney, it seems to Me You are only Receiving Half of what You are Entitled to, the Monetary Portion but not the Medical Portion, which sounds as if the Latter is the Most Important at this Point!
